Welcome to "Heyday" (the "Service"). These Terms of Service (the "Terms") govern the rights, obligations, and responsibilities between Hills Inc. (the "Company") and you, the user.
By using the Service, you are deemed to have agreed to these Terms. If you do not agree to these Terms, please stop using the Service.
These Terms set forth the rights, obligations, responsibilities, and other necessary matters between the Company and the user in connection with the use of the "heyday" service provided by the Company.
The terms used in these Terms are defined as follows.
The Company will post these Terms within the Service or on a linked screen to notify users.
The Company may amend these Terms within a scope that does not violate applicable laws. When the Terms are amended, the Company will provide notice within the Service specifying the amended content and the effective date.
The amended Terms take effect from the announced effective date, and if the user continues to use the Service after the effective date of the amended Terms, the user is deemed to have agreed to the amended Terms.
The Service provided by the Company includes the following.
The user may create an account to use the Service. Upon first launch, the Company may automatically create an anonymous account based on a device identifier, and the user may subsequently link such account to an authenticated account via Social Login.
The user may create an account or link to an existing account through the social login methods provided by the Company, such as Apple or Google. When using Social Login, the terms of service and privacy policy of the relevant provider also apply.
The user must keep account information accurate and up to date and is responsible for the security of the account. If unauthorized use of the account is detected, the user must promptly notify the Company.
An anonymous account is tied to the device and may become inaccessible upon app deletion, device change, or reset of the device identifier. To preserve held assets, users are encouraged to link the account via Social Login.
The user may accumulate Points or Gold upon meeting conditions set by the Company, such as mission completion and advertisement viewing. The accumulation ratios and conditions are subject to the Company's policy, which may change from time to time at the Company's discretion.
The user may exchange accumulated Points or Gold for products provided by the Company. The types, prices, and availability of exchangeable products may differ depending on the user's country and the Company's policy.
Fulfillment of product exchange requests is performed by the Company or a third-party operator designated by the Company, and some products may be delivered manually after operator review.
Points and Gold are virtual assets accumulated without charge and cannot be withdrawn as cash, transferred, or inherited. They may expire upon prior notice in cases set by the Company or after a prolonged period of inactivity.
Expired assets are not recoverable, and the Company does not provide any separate compensation for such expiration. Refunds and cancellations after a product exchange has been completed are governed by the relevant product provider's policy and applicable laws.
If the user obtains or attempts to obtain Points, Gold, or products through fraudulent means, the Company may recover such assets and products and restrict the user's use of the Service.
The Company may display advertisements within the Service in various forms, including banners and rewarded ads, for the operation of the Service.
The user may obtain additional rewards or use auxiliary features through advertisement viewing. Whether to view advertisements is at the user's discretion.
The Company is not responsible for the legality or accuracy of advertisement content provided by advertisers. Where the user transacts with an advertiser through an advertisement, such transaction is between the user and the advertiser, and the Company bears no responsibility for it.
Only with the user's explicit consent, the Company collects the device's location information to provide location-based auxiliary services such as nearby park recommendations.
The user may withdraw consent to provide location information at any time through device settings; upon such withdrawal, the use of location-based auxiliary services may be limited.
The user must not engage in any of the following acts.
If the user breaches the above obligations, the Company may impose measures such as restricting Service use, suspending or terminating the account, and recovering accumulated assets.
The Company may modify, change, add, or suspend all or part of the Service to improve service quality.
Where there is a material change to the Service, the Company will notify users in advance through in-Service announcements. However, in unavoidable cases such as emergency system maintenance or incident response, the Company may provide notice after the fact.
If the Company changes or suspends all or part of the Service provided free of charge, no separate compensation is provided.
All intellectual property rights to the content included in the Service (texts, graphics, logos, images, mission content, software, etc.) belong to the Company or its rightful owners.
Without the Company's prior written consent, the user may not reproduce, modify, distribute, transmit, disclose, sell, or commercially use any content included in the Service.
The Company protects the user's personal information in accordance with applicable laws, and matters regarding the collection, use, and provision of personal information are governed by a separate Privacy Policy.
The privacy policies of the relevant providers (Apple, Google, etc.) also apply to the processing of information collected through Social Login.
The Company is not responsible for the following matters.
The Company bears no liability in connection with services provided free of charge, unless otherwise specifically provided by applicable laws.
Unless attributable to the Company's intent or gross negligence, the Company bears no liability for indirect, special, consequential, or punitive damages arising in connection with the use of the Service.
These Terms are construed and applied in accordance with the laws of the Republic of Korea.
If a dispute arises between the Company and the user in connection with the use of the Service, both parties shall consult in good faith to reach an amicable resolution.
If the parties fail to reach an agreement, either party may file a lawsuit in the court having jurisdiction under the Civil Procedure Act.
Entire Agreement: These Terms constitute the entire agreement between the Company and the user regarding the use of the Service and supersede all prior agreements.
No Waiver: The Company's failure to exercise or enforce any provision of these Terms shall not be construed as a waiver of such right.
Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
